Current rules for 4.9GHz (Public Safety) in FCC land?

We’re curious about what the current rulings are for using 4.9GHz in FCC jurisdiction - apparently there are new rulings in the works, but we’re a bit unclear on current operation rules. In 450b 5GHz, there is the option to add 4945-4985 as custom frequencies in the software, but we assume it is not legal to transmit on these frequencies unless you are a public safety entity, or working with them in some capacity. If a WISP were to set up a system for a public safety entity, does that entity have the authority to allow you to use those frequencies? Do you need to obtain a specific license? How would one go about this?
